These Terms & Conditions (“Terms”) govern your access to and use of the 121 Letters website, membership program, pen pal matching service, mail forwarding service, and related products and services (collectively, the “Service”) operated by 121 Letters (“121 Letters,” “we,” “us,” or “our”).

By creating an account, purchasing a membership, submitting correspondence, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Service.

1. Purpose

121 Letters is a membership-based pen pal service designed to facilitate handwritten correspondence and meaningful connection between consenting members.

A core feature of the Service is helping members communicate without directly exchanging their residential mailing addresses. Members may send correspondence to 121 Letters, which may then be processed and forwarded to the intended recipient using a new outer mailing envelope.

121 Letters is not:

  • A postal carrier or governmental postal service

  • A courier or delivery company

  • A social media platform

  • A dating or matchmaking service for romantic relationships

  • A mental health, medical, legal, or financial service

  • A provider of professional advice

  • An intermediary responsible for the conduct, statements, or actions of members

121 Letters exists solely to facilitate handwritten correspondence between consenting members.

2. Eligibility

You must be at least 18 years old to use the Service unless 121 Letters expressly introduces a separate program for minors with additional parental or guardian requirements.

By using the Service, you represent and warrant that:

  • You are at least 18 years old.

  • You are legally capable of entering into these Terms.

  • All information you provide to 121 Letters is accurate and complete.

  • You will maintain accurate and current contact and mailing information.

  • You will use the Service only for lawful purposes.

  • You will comply with these Terms and all applicable laws and regulations.

121 Letters may require additional information or verification before permitting participation in the Service.

3. Description of the Service

Membership may include, depending on the membership plan purchased:

  • Pen pal matching

  • Mail forwarding

  • Participation in member activities or community exchanges

  • Rematching opportunities

  • Letter-writing resources

  • Other benefits specifically described at the time of purchase or subsequently offered by 121 Letters

The specific features included with a membership may change over time.

121 Letters does not guarantee:

  • Immediate matching

  • A match within a particular period, except where expressly stated otherwise

  • A specific number of matches

  • A particular geographic location of a pen pal

  • Compatibility between members

  • That another member will respond to correspondence

  • That correspondence will continue for any particular period

  • That a member will become a friend or otherwise form a personal relationship with another member

  • Continuous availability of any particular feature

  • That every member will participate equally or consistently

Matching is based on information provided by members and on availability. Matching does not constitute an endorsement, recommendation, background check, or guarantee regarding another member.

If 121 Letters is unable to identify an appropriate match within four (4) weeks after a member becomes eligible for matching, 121 Letters may pause the member's matching service until a suitable match becomes available.

4. Member Participation and First Letter

Members are expected to make a good-faith effort to participate in the Service.

After being matched, a member is expected to send their first letter within thirty (30) days.

If a member does not participate after reasonable reminders from 121 Letters, their pen pal may request a rematch.

121 Letters may, in its discretion, rematch members when a member is inactive, repeatedly fails to respond, requests a rematch, violates these Terms, or when 121 Letters determines that rematching is appropriate for the continued operation or safety of the Service.

121 Letters does not guarantee that a rematch will be immediately available.

5. Mail Forwarding

Members send eligible correspondence to the mailing address designated by 121 Letters.

121 Letters may receive, sort, process, and forward eligible correspondence to the intended recipient using a new outer mailing envelope.

The sender's residential mailing address will not ordinarily be disclosed to the recipient through the 121 Letters forwarding process. However, members may voluntarily disclose their own address or other personal information through their correspondence.

Members acknowledge and consent to 121 Letters receiving and handling correspondence for the purpose of operating the Service.

Mail Processing and Opening

121 Letters generally does not read members' correspondence.

However, members expressly authorize 121 Letters and its authorized personnel, contractors, or service providers to open and inspect correspondence when reasonably necessary to:

  • Process, route, sort, or forward the correspondence;

  • Verify compliance with these Terms;

  • Identify prohibited or restricted items;

  • Investigate suspected fraud or abuse;

  • Investigate reports of harassment, threats, or other safety concerns;

  • Protect members, employees, contractors, or the business;

  • Address mail that cannot otherwise be properly processed or forwarded;

  • Comply with applicable law, legal process, postal requirements, or governmental requests; or

  • Resolve operational or technical issues relating to the Service.

When correspondence is opened, authorized personnel will limit review to what is reasonably necessary for the applicable purpose and are expected not to intentionally read correspondence beyond what is reasonably necessary to perform their duties.

Members understand that mail handling necessarily involves access to physical correspondence and that 121 Letters cannot guarantee that correspondence will never be viewed, opened, delayed, damaged, misplaced, or accessed by an unauthorized person.

6. Permitted Correspondence

Unless otherwise approved by 121 Letters, permitted correspondence generally includes:

  • Handwritten letters

  • Greeting cards

  • Photographs

  • Postcards

  • Flat paper correspondence

  • Drawings

  • Other flat paper items approved by 121 Letters

Eligible correspondence must comply with applicable USPS letter-size requirements and must not exceed 11½ inches in length, 6⅛ inches in height, ¼ inch in thickness, or 3.5 ounces in total weight.

Correspondence must be flexible, securely enclosed, and suitable for standard letter-mail processing. Items that are unusually rigid, bulky, irregularly shaped, improperly packaged, or otherwise likely to require additional postage, special handling, or a different mail classification may be rejected, returned, or subject to additional postage and handling fees.

121 Letters may establish additional size, weight, thickness, packaging, or formatting requirements at any time to maintain consistent processing, postage, and operational costs. Members are responsible for complying with the requirements in effect when correspondence is submitted.

7. Prohibited and Restricted Mail

Members may not send or attempt to send through the Service:

  • Cash or currency

  • Gift cards

  • Checks or negotiable instruments

  • Medication or prescription drugs

  • Illegal substances

  • Controlled substances

  • Weapons or weapon components

  • Hazardous materials

  • Flammable or dangerous materials

  • Liquids

  • Food or perishable items

  • Electronics or batteries

  • Merchandise or commercial products

  • Bulky or oversized items

  • Passports or government-issued identification documents

  • Government documents or other official documents

  • Items requiring customs declarations

  • Packages or parcels unless expressly authorized by 121 Letters

  • Items prohibited by USPS or other applicable postal authorities

  • Any item prohibited by federal, state, local, or international law

121 Letters may prohibit additional items at any time based on legal, postal, operational, safety, or business considerations.

121 Letters may restrict participation from particular countries, territories, jurisdictions, or regions because of legal, regulatory, postal, sanctions, privacy, safety, or operational limitations.

Members are responsible for ensuring that anything they send through the Service complies with applicable law and postal requirements.

8. Handling of Prohibited or Undeliverable Items

If 121 Letters receives an item that violates these Terms or applicable law, 121 Letters may, to the extent permitted by law:

  • Decline to forward the item;

  • Hold the item temporarily for investigation or resolution;

  • Return the item to the sender;

  • Require the sender to reimburse reasonable return postage, shipping, storage, or handling costs;

  • Dispose of the item where permitted or required by law;

  • Surrender the item to the appropriate authority where legally required; or

  • Suspend or terminate the sender's membership.

121 Letters is not responsible for loss or damage to prohibited items.

Repeated violations may result in permanent removal from the Service.

9. Member Conduct

Members agree not to use the Service to:

  • Harass, intimidate, stalk, or threaten another member;

  • Send abusive, unlawful, or threatening correspondence;

  • Engage in fraud, deception, or impersonation;

  • Solicit money or financial assistance from another member;

  • Request or solicit sensitive financial information;

  • Advertise or promote products, services, businesses, or commercial ventures without authorization;

  • Spam or send unsolicited mass correspondence;

  • Engage in illegal activity;

  • Send prohibited items;

  • Attempt to circumvent the 121 Letters privacy or mail-forwarding system;

  • Attempt to obtain another member's residential address without their consent;

  • Share another member's personal information without authorization;

  • Use the Service for romantic or sexual solicitation in violation of 121 Letters policies;

  • Circumvent a suspension, termination, rematch, or other restriction imposed by 121 Letters; or

  • Otherwise use the Service in a manner that could reasonably create a safety, legal, operational, or reputational risk for 121 Letters or its members.

Members are solely responsible for the content and consequences of their correspondence.

10. Member-to-Member Relationships

121 Letters facilitates introductions and correspondence but does not control the conduct of members.

121 Letters does not conduct criminal background checks, identity verification, psychological evaluations, relationship compatibility assessments, or other investigations of members unless expressly stated otherwise.

Members are solely responsible for deciding what personal information they disclose, whether they continue communicating with another member, and whether they pursue any relationship outside the Service.

Members should use appropriate caution when communicating with people they do not know personally.

121 Letters does not guarantee the identity, character, intentions, honesty, age, location, or conduct of any member beyond any verification procedures expressly stated by 121 Letters.

11. Ending Correspondence

Either member may request to stop corresponding at any time.

When correspondence is ended:

  • 121 Letters may stop forwarding future correspondence between the members;

  • Additional letters received after the correspondence has ended may be returned to the sender or otherwise handled in accordance with 121 Letters' policies;

  • A member may be notified that the correspondence has ended, but 121 Letters is not required to disclose the reason for the decision; and

  • 121 Letters may offer or facilitate a rematch where appropriate.

121 Letters reserves the right to discontinue correspondence when it determines that doing so is reasonably necessary for safety, policy compliance, operational reasons, or the protection of members or the business.

121 Letters is not required to provide detailed explanations for individual matching, rematching, suspension, or correspondence-discontinuation decisions.

12. Suspension and Termination

121 Letters may suspend, restrict, or permanently terminate a member's access to the Service, with or without prior notice, when reasonably necessary, including for:

  • Violation of these Terms;

  • Harassment or abusive behavior;

  • Safety concerns;

  • Fraud or suspected fraudulent activity;

  • Illegal activity;

  • Sending prohibited items;

  • Failure to pay membership fees;

  • Repeated inactivity;

  • Attempts to circumvent Service restrictions;

  • Providing false or misleading information;

  • Conduct that may harm another member;

  • Conduct that may negatively affect the Service or business; or

  • Any other circumstance in which 121 Letters reasonably determines that continued participation is inappropriate.

Immediate suspension or termination may occur when 121 Letters reasonably believes that delay could create a safety, legal, financial, or operational risk.

Termination does not eliminate any obligations that arose before termination.

13. Membership Fees, Billing, Cancellation, and Refunds

Membership pricing and billing frequency will be disclosed at the time of purchase.

Unless otherwise stated at checkout, memberships may automatically renew at the applicable recurring rate until canceled.

By purchasing a recurring membership, you authorize 121 Letters or its payment processor to charge the applicable payment method for recurring membership fees.

You may cancel your membership using the cancellation method provided by 121 Letters. Cancellation will prevent future renewal charges but does not ordinarily entitle you to a refund for a billing period that has already begun.

Unless otherwise required by law or expressly stated by 121 Letters, membership fees are non-refundable and are not prorated for partial months or unused portions of a membership period.

If a member's account is suspended or terminated because of a violation of these Terms, the member is not entitled to a refund for unused membership time unless required by applicable law.

121 Letters reserves the right to change membership pricing upon reasonable notice. Any price change will apply to future billing periods and will not retroactively change charges already incurred.

14. Lost, Delayed, Damaged, or Misdelivered Mail

121 Letters is not a postal carrier and cannot guarantee delivery times.

To the fullest extent permitted by law, 121 Letters is not responsible for:

  • USPS or other postal-service delays;

  • Lost mail;

  • Damaged mail;

  • Misdelivered mail;

  • Postal service interruptions;

  • Weather-related delays;

  • Natural disasters;

  • Incorrect or incomplete addresses provided by members;

  • Mail returned by a postal service;

  • Mail that cannot be forwarded because it does not comply with these Terms; or

  • Delays caused by circumstances outside 121 Letters' reasonable control.

Any forwarding timeframe provided by 121 Letters is an estimate and is not a guaranteed delivery date.

Members should not send original documents, irreplaceable items, valuable property, or anything they cannot afford to lose through the Service.

15. Privacy and Personal Information

121 Letters collects and uses personal information as described in its Privacy Policy.

Members consent to 121 Letters collecting, receiving, storing, processing, and handling information and correspondence reasonably necessary to provide and operate the Service.

121 Letters will use reasonable administrative, technical, and physical safeguards designed to protect member information. However, no method of transmission, storage, or physical mail handling can be guaranteed to be completely secure.

Personal information may be retained for as long as reasonably necessary to operate the Service, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud or abuse, maintain business records, or otherwise fulfill legitimate business purposes.

When information is no longer reasonably necessary for these purposes, 121 Letters may delete, destroy, or anonymize it in accordance with its retention practices and applicable law.

Members should not assume that another member will keep voluntarily disclosed personal information confidential.

Members are solely responsible for deciding what personal information they include in letters or otherwise disclose to another member.

16. Third-Party Services

121 Letters may use third-party providers to support payment processing, website hosting, email, mail handling, shipping, analytics, customer support, technology, or other business functions.

121 Letters is not responsible for the acts or omissions of third-party service providers except to the extent required by applicable law.

Use of certain third-party services may be subject to those providers' separate terms and privacy policies.

17. Intellectual Property

All content and materials provided by 121 Letters, including its name, logos, branding, website content, graphics, designs, written materials, templates, and other original materials, are owned by or licensed to 121 Letters and are protected by applicable intellectual property laws.

Members may use such materials solely for their personal, non-commercial use in connection with the Service.

Members may not reproduce, distribute, modify, sell, license, publish, or commercially exploit 121 Letters' intellectual property without prior written permission.

18. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

121 LETTERS DOES NOT WARRANT THAT:

  • THE SERVICE WILL ALWAYS BE AVAILABLE;

  • THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED;

  • A MEMBER WILL RECEIVE A MATCH;

  • A MATCH WILL BE COMPATIBLE;

  • A MEMBER WILL RESPOND TO CORRESPONDENCE;

  • MAIL WILL ARRIVE WITHIN A PARTICULAR PERIOD;

  • MAIL WILL NOT BE LOST, DAMAGED, DELAYED, OR MISDELIVERED; OR

  • THE SERVICE WILL MEET EVERY MEMBER'S EXPECTATIONS.

121 Letters does not guarantee the accuracy, reliability, identity, character, intentions, or conduct of any member.

Nothing in these Terms excludes or limits any right or remedy that cannot legally be excluded or limited under applicable law.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 121 LETTERS AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

  • USE OF OR INABILITY TO USE THE SERVICE;

  • ACTIONS OR OMISSIONS OF OTHER MEMBERS;

  • MEMBER-TO-MEMBER DISPUTES;

  • CONTENT OR STATEMENTS MADE BY MEMBERS;

  • LOSS OR DISCLOSURE OF INFORMATION VOLUNTARILY PROVIDED BY A MEMBER;

  • LOST, DAMAGED, DELAYED, OR MISDELIVERED MAIL;

  • INTERRUPTION OF THE SERVICE;

  • MATCHING OR REMATCHING DECISIONS; OR

  • TERMINATION OR SUSPENSION OF MEMBERSHIP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 121 LETTERS' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL MEMBERSHIP FEES ACTUALLY PAID BY THE MEMBER TO 121 LETTERS DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

20. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless 121 Letters and its owners, members, managers, employees, contractors, agents, affiliates, and service providers from and against claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • Your use or misuse of the Service;

  • Your correspondence or other content;

  • Your conduct toward another member;

  • Your violation of these Terms;

  • Your violation of applicable law or the rights of another person; or

  • Any prohibited item or material you send through the Service.

This obligation does not apply to the extent a claim is caused by conduct for which 121 Letters cannot legally require indemnification.

21. Force Majeure

121 Letters will not be responsible for any failure or delay in performing its obligations caused by circumstances beyond its reasonable control, including natural disasters, severe weather, fire, flood, power outages, internet or technology failures, postal disruptions, labor disputes, governmental actions, public emergencies, war, terrorism, or other events beyond 121 Letters' reasonable control.

22. Changes to the Service

121 Letters may modify, suspend, discontinue, or replace any portion of the Service at any time.

This may include changes to:

  • Matching procedures;

  • Mail-forwarding procedures;

  • Membership benefits;

  • Community activities;

  • Eligibility requirements;

  • Geographic availability;

  • Mail restrictions; and

  • Other operational policies.

121 Letters does not guarantee that any particular feature will remain available indefinitely.

23. Changes to These Terms

121 Letters may modify these Terms from time to time.

When material changes are made, 121 Letters may provide notice through the website, email, account, or other reasonable means.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the revised Terms.

If you do not agree to revised Terms, you must stop using the Service and cancel your membership.

24. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in Ohio, and you consent to the jurisdiction and venue of those courts.

Nothing in this section prevents either party from seeking emergency or equitable relief in a court of competent jurisdiction.

25. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

26. No Waiver

A failure by 121 Letters to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision in the future.

27. Entire Agreement

These Terms, together with the 121 Letters Privacy Policy and any additional terms expressly incorporated by reference, constitute the entire agreement between you and 121 Letters regarding your use of the Service and supersede prior or contemporaneous agreements concerning the Service.
